I live in a modest community and from the outside you would never know that our community has suffered numerous water damage breaks.  Some of the residents have endured up to four water breaks in their homes.  Can you imagine coming home after a hard day’s work and finding two inches of water on your floors and furniture?  At first our management company and Board of Directors thought it was just “bad luck”.  But after numerous water damage claims, we realized there was a pattern.  How could there pipes just keep breaking the walls and under our cement slabs?  It was beginning to cost our community a small fortune and we needed some answers fast.

After much debate, we decided the problem must be faulty plumbing and decided to sue the builder of our community and PEX the manufacturer of the plumbing.  Only 17 out of the 187 units in our community were still under warranty, so the lawsuit was only filed for those 17 still within warranty.  The suit was eventually settled out of court with the court ruling in favor of the plaintiff.  We have since re-plumbed those 17 units and feel confident that the issue for these 17 units has been resolved.  However, as a community, we are still dealing with the unexpected expense of broken/bad piping on the remaining units.  This continues to be a financial drain on our finances.  The remaining units that were not re-plumbed are still a ticking time bomb.

In 2007, a class action lawsuit was filed by homeowners in Minnesota claiming the PEX brass fittings used were defective.  As a community we are moving forward to join this action in the hopes that we can end this plumbing nightmare.
